Hong Kong Releases Guidance on Strict Rules for Stablecoin Issuers

Hong Kong’s drive to become a leading global hub for digital assets continues with the Hong Kong Monetary Authority (HKMA) releasing comprehensive guidelines for stablecoin licensing. Effective Friday, these guidelines establish stringent requirements for capital reserves, governance, technology, and anti-money laundering (AML) measures for issuers. The May-passed bill formalizing these regulations sets the stage for a regulated stablecoin market.

While around 40 firms await licensing applications, the HKMA anticipates approving fewer than 10 initially, reflecting a cautious approach. HKMA CEO Eddie Yue cautioned against unrealistic expectations, emphasizing a focus on genuine stablecoin-related businesses. The regulator’s concerns stem from the challenges in effectively mitigating money laundering risks within the stablecoin ecosystem.

The guidelines mandate robust identity verification for stablecoin holders, even those lacking direct relationships with the licensee, unless the issuer demonstrably mitigates AML risks. This verification can be facilitated by licensed virtual asset service providers or reliable third parties. Hong Kong’s existing licensing regime for crypto companies, initiated last year, complements this new framework.

The HKMA’s consultation response highlights a commitment to ongoing evaluation and adaptation of these measures in light of the evolving regulatory landscape. The regulator encourages fully prepared stablecoin issuers to submit applications by the end of September, with license approvals anticipated in early 2024. Deputy CEO Darryl Chan Wai-man clarified this timeline, emphasizing the considered approach to the region’s stablecoin regime.

This regulatory framework underscores Hong Kong’s strategic intention to foster innovation while prioritizing financial stability and security within its burgeoning digital asset sector. The stringent requirements aim to minimize risks and build confidence in the stablecoin market, attracting reputable players and contributing to the long-term growth of the industry.
