U.S. Senators Pitch New Crypto Market Structure Framework as Hearing Approaches

U.S. senators have unveiled a framework for regulating domestic crypto markets, aiming to provide clarity for the industry while addressing concerns about illicit finance and national security. This framework, released by Senate Banking Committee Chairman Tim Scott and three Republican colleagues, serves as a basis for negotiations on a comprehensive bill. The principles emphasize establishing clear distinctions between digital securities and commodities, preventing the emergence of an overly powerful regulatory body, and implementing targeted anti-money laundering measures that encourage innovation. The senators also encourage federal regulators to utilize tools like no-action guidance, regulatory sandboxes, and safe harbors to foster responsible development.

The Senate’s move follows the recent passage of the Guiding and Establishing National Innovation for U.S. Stablecoins (GENIUS) Act, demonstrating bipartisan progress on crypto regulation. The focus now shifts to establishing a broader regulatory structure for all crypto activities. A Senate hearing is scheduled to further discuss these market structure proposals. Senator Cynthia Lummis highlighted the need for U.S. action, emphasizing that the lack of clear regulations is pushing the digital asset industry towards jurisdictions with more established frameworks.

The House of Representatives has already passed its Digital Asset Market Clarity Act, but the Senate’s approach remains to be determined. Three options are under consideration: passing the GENIUS Act as is; merging it with the House’s stablecoin legislation; or combining both stablecoin and market structure regulations into a single bill. This decision will significantly impact the legislative process and the final form of crypto regulation. While bipartisan support exists, Democrats have voiced concerns regarding illicit finance, national security, and President Trump’s past crypto involvement. The interplay between the House and Senate bills, along with the resolution of Democratic concerns, will shape the future of crypto regulation in the United States.
