FBI Drops Criminal Probe Into Kraken Founder Jesse Powell
Federal authorities have concluded their criminal investigation into Jesse Powell, co-founder and former CEO of Kraken, without filing charges. The investigation, initiated in 2023 by the FBI, stemmed from allegations by the Verge Center for the Arts that Powell had hacked its computer systems and obstructed email access. This action led to a search of Powell’s home, resulting in the seizure of computers, laptops, and cell phones.
In April 2024, federal prosecutors informed Powell’s attorney, Brandon Fox, of their decision to close the case, citing insufficient evidence to pursue criminal charges. They also committed to returning the seized devices. Subsequently, in June 2024, the U.S. Attorney’s Office for the Northern District of California formally confirmed the closure of the investigation, which had officially ended on April 8th, 2024.
Powell expressed strong disapproval of the investigation, stating that the FBI raid was personally and professionally devastating, and that it was based on unfounded accusations. He intends to pursue legal action against those responsible for initiating the investigation based on allegedly false statements to law enforcement.
This development comes at a time when Kraken is considering an initial public offering (IPO) potentially by the first quarter of 2026. Powell, who stepped down as CEO in 2023 but remains on the board of directors, will likely be closely watching this event. Kraken, one of the largest US-based cryptocurrency exchanges, has faced increased regulatory scrutiny in recent years. This included a 2023 settlement with the Securities and Exchange Commission (SEC) and the subsequent termination of its US staking services.
The dismissal of the criminal charges against Powell removes a significant legal hurdle for both Powell personally and for Kraken’s future prospects. The unfounded nature of the accusations, as Powell claims, could have negative implications for the Verge Center for the Arts and raise concerns about the basis of such allegations against prominent figures in the cryptocurrency industry.
